SCC019 COA

DATE: April 24, 2024

A recall has been implemented for a batch of cannabis infused pre-rolls distributed by UC Advisor Corporation because the batch contains Aspergillus and therefore poses a health risk to consumers. In addition, the batch has inaccurate THC content labeling of the cannabis good causing it to also be adulterated and misbranded.

The Department of Cannabis Control has confirmed the presence of Aspergillus flavus and inaccurate THC content labeling in the following batch: UID Number 1A4060300002CF8000000552, 1A4060300047BA9000000316, or 1A4060300047BA9000000317, or batch number SCC019. The batch does not meet the microbial impurities standards established in California Code of Regulations, title 4, section 15720 and is therefore adulterated pursuant to Business and Professions Code section 26039.6, subdivision (a)(4). The Department also sampled and analyzed the batch for cannabinoids and determined that the infused pre-roll contains 19.8% Total THC, however the product label states the product contains 35.2% Total THC. This represents a difference of 43.75% and is significantly greater than the allowable variance of 10%. The batch does not meet the standards established in California Code of Regulations, title 4, section 15307.1, subdivision (e), and is therefore adulterated pursuant to Business and Professions Code (BPC) section 26039.6, subdivision (a)(5) and misbranded pursuant to BPC section 26039.5 subdivision (a)(3). All retail sales and distribution of the adulterated and misbranded batch must cease immediately. It is unlawful to distribute, sell, deliver, hold or offer for sale an adulterated or misbranded cannabis good.
